The represented company filed a claim with the Vilnius Regional Court for a guarantee of LTL 908,897, which was transferred to the defendant’s account because, in its view, the represented company had improperly performed the contract. In its judgment of 12 December 2012, the court found that the contract had not been performed on time not through the fault of the company represented but due to force majeure circumstances, i. the defendant received the amount of LTL 908,897 illegally.
