This privacy policy (hereinafter – Privacy Policy) is designed to explain how We collect, store, use and otherwise process your personal data when you use our Website http://www.jonuska.legal (hereinafter – Website) or social media accounts, or by e-mail or phone, or obtained by us in connection with the performance of contracts with our partners or clients an employee or a representative of whom you are.

We may update this Privacy Policy from time to time unilaterally, in our sole discretion. Be sure to periodically check this page to ensure that at all times you are aware of any changes to this Privacy Policy. Changes of the Privacy Policy come in to force on the day they are published on the Website. Because of this reason, as you visit the Website you have to make sure that you are aware of the latest version of the Privacy Policy that is posted on the Website. If you continue to use the Website after the effective date of the changes, We will consider it as your agreement with the new Privacy Policy.

What kind of personal data do We collect?

We process data about your use of our website. We may collect the following information for the purpose of providing and administering legal services – personal data of a data subject (hereinafter – Client) who enters into a contract for legal services with Us: data contained in such contract; personal data disclosed by the Client; data that will be collected by Us from other sources, such as publicly available sources, registers, etc., during the provision of services. The legal basis for processing this data refers to processing necessary for the compliance with obligations subject to a contract and/or law, and/or for the purposes of legitimate interest or for the performance of a contract and/or in order to take steps at the Client’s request prior to entering into a contract for legal services. The personal data processed for the purpose of providing and administering legal services will be stored for 10 (ten) years as of the fulfilment by us of your last assignment, except where a longer period is established by laws and/or other regulations. For the purposes of providing and administering the services, we process special categories of your personal data only with your express consent and / or in order to file, enforce or defend your legal claims.

For the direct marketing purposes, we process your name and email address by sending you our messages and/or other information via email. We process this data on the basis of your consent. In addition, if we have already provided services to you and you have not objected to the processing of your personal data for direct marketing purposes, we will process the personal data on the basis of a legitimate interest, namely to maintain and improve relationships with the existing clients. If you have not objected to the processing of your data for direct marketing purposes, we will process this data until the date of termination of legal services, and if you are not our client and have simply given your consent to receive direct marketing messages, we will keep your data for 3 (three) years after the day of your consent.

For the purpose of communicating with you, we process your name, surname, email address, phone number and contents of communication. We process this data on the basis of consent and store it for 2 (two) years starting from the date of the last communication with you. If you are our client, we will store this information until the date of termination of legal services. We may process any other personal data you may provide to us at any time by contacting us by e-mail or phone or by visiting our office. This data will be processed on the basis of your consent and will be stored for 2 (two) years from the date of your consent.

How is your personal data processed?

Your personal data will be processed in accordance with the Law of the Republic of Lithuania on Legal Protection of Personal Data and other regulations. When identifying the means of personal data processing and in the course of such processing, We undertake to implement appropriate technical and organizational measures for protecting your personal data from accidental or unlawful destruction, damage, modification, loss, disclosure or any other kind of illegal processing and to adopt proper measures taking into account the risks around your personal data processing.

In cases where during the performance of a contract for legal services the data are not obtained directly from the Client, the notification obligation will not apply because of the lawyer’s (i) statutory duty of confidentiality, and (ii) the right to receive and collect information (special categories of personal data including) and to perform processing operations on such information.

Who we share your personal data with?

Personal data made available to Us in connection with our provision of legal services may be disclosed to the following persons for the purpose of providing such services (i) to courts, bailiffs, national or local authorities, agencies and/or organisations, or (ii) to our partners in other countries or to certain professionals (e.g. auditors, lawyers, translators, etc.), or (iii) to opposing parties before which We represent the Client, or (iv) to any other parties, including providers of certain services, such as IT, translation, courier and similar services.

We may share your personal data with a variety of third-party service providers who provide services and process personal data on our behalf. These service providers have access to your information only to perform these tasks and are contractually bound to implement appropriate organizational and technical security measures to protect your personal data, and only to process personal data following our instructions and to the extent necessary to provide their services to us. We must disclose your personal data to fraud and crime prevention agencies for the purpose of assessing the risk of crime, fraud and money laundering and this is a condition of us entering into any contract with you. In this case your personal data is disclosed under the regulatory requirements. We may disclose your information to courts, law enforcement agencies, and governmental authorities that may request relevant information.

We provide information to you free of charge, but if the requests are going to be manifestly unfounded or excessive, in particular because of their repetitive character, we may charge a reasonable fee with regard to administrative costs or refuse to act on your request.

You have the right to file complaints about data processing activities, but first of all we will try to resolve all the misunderstandings directly with you.
